International Protection (Asylum law)
In accordance to the Refugee Law of 2000, a ''Refugee'' is third-country national who, owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, political opinion or membership of a particular social group, is outside the country of nationality and is unable or, owing to
such fear, is unwilling to avail himself or herself of the protection of that country, or a stateless person,
who, being outside of the country of former habitual residence for the same reasons as mentioned
above, is unable or, owing to such fear, unwilling to return to it.
The responsibility for examining and deciding on asylum applications in Cyprus lies with the Asylum
Service. According to the provisions of the Refugee Law, individuals seeking asylum are required to
submit their application to the Asylum Service. The services provided by the Asylum Service encompass
the identification, registration, and acceptance of asylum applications, as well as conducting medical
screenings and vulnerability assessments.
To ensure that asylum seekers in Cyprus have the right to an effective legal remedy, a specialized court,
the International Protection Administrative Court (IPAC), was established in 2019.
In the event of a negative decision on an asylum application by the Asylum Service, the asylum seeker
retains the right to file an administrative recourse before the IPAC, as provided by Article 146 of the
Constitution of the Republic of Cyprus. The deadline for filing such recourse is 30 calendar days, or 15
calendar days for cases falling under accelerated procedures. All decisions issued by the IPAC can be
appealed to the Supreme Court within a timeframe of 14 days.

Administrative law
Article 146 of the Constitution provides individuals with the right to challenge administrative actions.
Should an administrative decision be found to contradict the provisions of the Constitution or the
corresponding legislation, the Court has the authority to invalidate the decision entirely or, in specific
circumstances, modify it, or identify a failure by the administrative authority, resulting in the decision
being rendered invalid, either wholly or partially.
The Eighth Amendment to the Constitution empowered the Administrative Court not only to invalidate administrative acts but also to make amendments to them in specified situations. Nevertheless, the predominant exercise of the Administrative Court's jurisdiction continues to be through annulments.
However, in certain cases and subject to specific conditions, the Administrative Court is also capable of
exercising substantive jurisdiction and reviewing appeals.
